Join the REIV for lunch to discuss the risks associated with the sale of businesses and tips on how to recover commission. 


Our guests speakers, Darren Cain, Principal Lawyer at KCL Law, and Ken Welsh, Managing Director at JUA Underwriting will explore:
 

  • The agents rights to retain, sue or recover commission for the sale of business with emphasis on Section 49A of the Estate Agents Act.

  • Risk Management involving claims such as misrepresentation of facts, silence by omission, false account keeping and more.       


The lunch will highlight the recent court decisions on Section 49A of the Estate Agents Act and discuss how this may impact on the right to commission under Exclusive Sale Authorities.

Darren Cain - Principal Lawyer, KCL Law

As Principal Lawyer and Head of KCL Law's Estate Agency and Business Broking Team, Darren has over the past 18 years represented real estate agents and business brokers on sale of businesses, recovery of commissions and provided advice on risk mitigation strategies and procurement of rent rolls.

Darren is well known to Business Brokers.




 

Ken Welsh – Managing Director at JUA Underwriting

Ken Welsh, Executive Chairman at JUA Underwriting Agency, has been principal officer/sole proprietor for the past 40 years. Ken has 60 years insurance and reinsurance experience in Australia and overseas and has held senior management roles in both Underwriting and Claims.

Ken is a Fellow of the ANZIIF and has a Diploma of Financial Services.  Ken is also a pioneer in the professional insurance education arena and is a former Chief Examiner for the Australian Insurance Institute.
