Sale of Land Amendment Act 2019 - Material Fact Guidelines

CAV released the Material Fact Guidelines on 1 March 2020 as part of the Sale of Land Amendment Act 2019.
The Act requires that a vendor or their agent must disclose all known material facts, as soon as a prospective buyer indicates they are considering buying the property – commercial or residential. Vendors and agents must not knowingly conceal from a prospective buyer any material facts when selling land. The Guidelines assist in understanding what a material fact could be.
 
Material facts include any fact that an average purchaser would regard as material in their decision to buy and could range from information on a murder in the property through to offensive odours from a neighbouring property.

Gil King joined the REIV as CEO in early 2017. Gil brings a wealth of experience to the role, both within membership organisations and within policy and regulatory environments. Gil was most recently Executive Director of the Housing Industry Association, a role held since 2009. He has had over 20 years’ involvement in the building industry, including as Director Regulatory Compliance at the Victorian Building Commission (now Victorian Building Authority).

Andrew Meehan is Co-Founder, Director and CEO of the Nicholas Lynch Real Estate Group which was REIV Medium Residential Agency of the year in 2015,2016, 2017 & 2018 and Property Management Team of the Year in 2019. Andrew joined the real estate industry late in his career and prior to this had extensive Director and Senior Management experience in a wide variety of Industries of both private and publicly listed companies both in Australia and overseas. Andrew is also co-founder and Chairperson of the Listing Loop Group. Andrew is a Licensed Estate Agent and a qualified Land Surveyor and holds a Master of Business Administration. Andrew is chairperson of the REIV Sales Chapter and a member of the Members Council of the REIV.
