REIV Commitment to Protecting Your Privacy
The REIV acknowledges the importance of protecting the privacy of its Members and the privacy of other users who may access services provided via the REIV web site. The following privacy statement applies to all information provided by individuals or organisations seeking services or providing information to the REIV via its web site or to ancillary web site services.
The REIV collects personal information in order to deliver services and products to its Members, to the broader real estate community and to non-REIV Members and members of the public seeking to use its services. In using the REIV web site your IP address will be collected to assist with the diagnosis of problems and support issues associated with our services. This information is gathered in aggregate only and cannot be traced to an individual user.
For the purposes of site-user analysis, the REIV utilises third-party software to assess site traffic. A tracking code is used to collect the following information:
Information will only be collected in a lawful and fair manner. Where users do not feel comfortable providing information required to access a specific service they should contact the REIV web programmer at reiv@reiv.com.au.
Where individuals wish to access their personal information provided to the REIV via its web site this can be achieved by contacting reiv@reiv.com.au.
Information collected by the REIV via its web site will not routinely be passed on to any third party organisations without the consent of the individual. Where any information may be provided from the REIV web site to a third party this will be clearly stated before individuals can access any REIV web-based services.
Resumes
Where individuals are providing resume details to the REIV for the purposes of placing them on the ‘REIV Agent's Representative Graduates Seeking Employment’ site, these details will be available for viewing, printing and downloading by REIV Members and staff members of REIV agencies. Where an individual nominates referees as part of this service they should expect that prospective employers viewing the web site will contact those referees.
In posting your resume to the ‘REIV Agent's Representative Graduates Seeking Employment’ site you will be given the option of also providing information relating to professional associations and memberships; however it is not mandatory to complete this in order to place your details on the site.
By providing these details in your resume, you are consenting to have this information viewed, downloaded or printed by REIV Members or staff members of an REIV Member agency.
Use and Disclosure of Personal Information
The REIV will use and disclose personal information for the primary purpose for which it was collected and may also use and disclose personal information for secondary purposes that are related to the primary purpose and which the person providing the personal information would reasonably expect. In providing personal information, a person consents to the REIV using and disclosing the personal information to assist an enforcement body or Consumer Affairs Victoria or the Business Licensing Authority or the Australian Competition and Consumer Commission perform its functions or to prevent a threat to life and to ensure health and safety.
Complaints about estate agents / agent's representatives
If an individual provides personal information in relation to a complaint about an estate agent or and agent's representative, the individual consents to the REIV using and disclosing the personal information to the estate agent or agent's representative in connection with its investigation of the complaint or using or disclosing the personal information to an enforcement body or to Consumer Affairs Victoria or to the Business Licensing Authority or to the Australian Competition and Consumer Commission or to a municipal council to assist with the performance of its functions or to prevent a threat to life and to ensure health and safety
Where an individual is providing information to the ’REIV Agents Representative Graduates Seeking Employment’ site they will be required to receipt and acknowledge their agreement with the REIV privacy policy prior to providing any personal information.
The REIV will take all reasonable steps to ensure that all personal information it collects or uses will be accurate, complete and up-to-date.
The REIV will take all reasonable steps to protect personal information that it collects or holds from misuse, loss or unauthorised access. For individuals providing personal information to the ‘REIV Agent’s Representative Graduates Seeking Employment’ web site they should expect that this information will be available to the industry broadly.
The data required for this function will be entered by the individual (recently graduated REIV student) and as such the integrity and the accuracy of the data provided will be contingent on that person making the entry.
The REIV will not be held responsible for events arising from unauthorised access of your personal information.
Individuals placing information onto the REIV web site also have an obligation to keep their personal information secure by maintaining the confidentiality of any password provided by the REIV for access to the site. On request, individuals can be advised of the sort of data that the REIV holds on that individual, how that information is held and how it discloses that information.
Where a request is made by an individual to access their personal information, access will be provided by the REIV. Where a person requires access to update or amend an inaccuracy in their personal information, access will also be provided. For any changes to be made to your personal details you should email the REIV at reiv@reiv.com.au.
Exceptions to access of personal information apply, e.g. if it poses a serious threat to life or health, if it is vexatious, if it impacts on another person’s privacy, if there are legal proceedings, or if it is prejudicial to a police investigation.
The REIV provides links from its web site to third party organisations. These third party sites/organisations are not within the control of the REIV and we do not accept responsibility for the conduct of these organisations. The REIV will not be liable for any damages or loss arising in any way out of or in connection with service provided by any third party.
The REIV will use an identifier in place of a person’s identity. In addition to a person's personal identification, the REIV will also provide a membership number to REIV Members as is consistent with REIV Association rules. Under no circumstances will the REIV use an identifier assigned by a Commonwealth Government agency, such as a social security number, for the purposes of identifying clients.
Where it is practicable, and where personal identification is not required, the REIV will provide people with the option to communicate with anonymity.
The REIV will not transfer personal information to a recipient in a foreign country:
(a) without the prior consent of any individual whose personal information is contained in that data;
(b) unless the country in question has similar privacy legislation and protections as Australia.
The REIV will not collect sensitive information unless the person has consented or it is required by law or in special circumstances, for example, to a health service or for public health or safety.
The main consequences for an individual who does not provide personal information will be that the REIV may not be able to provide the service sought, investigate a complaint, or respond to an inquiry.
